Litigation involving the Department of Child Services

Some things to remember when dealing with DCS.  

• Stop communicating with individuals who you believe to be responsible for the report.
• Never make a statement to DCS, law enforcement, news media, or anyone else without your attorney present.
• Maintain a record of every phone call, text message, email, interview, conversation, or other communication related to the allegation or subject of child abuse.
• Cooperate with authorities, but only to the extent advised by your attorney. Remember that they are looking for evidence to use against you, not help you.
• Reach out to trusted friends, relatives, coworkers, and neighbors about being a character witness for you.

Legal Separation is generally the avenue we advise our clients to pursue when they first call in for a divorce. Legal Separation provides for a method of protecting yourself against the painful decisions of a spouse who may have left or a situation where divorce is being considered,  while still allowing the parties to pursue counseling in the ultimate goal of reconciliation between the parties. 

The process of legal separation can be converted to divorce at any point in time before it expires so this will not add to your costs associated with a divorce, while giving the parties another chance to avoid what could be something they regret for many years to come.
